Sartori. 303-452-6611 <br />Dear Ms. Sartori: <br />We have received your letter of August 31, 2009 requesting renewal of the substitute water <br />supply plan ("SWSP") to cover depletions caused by gravel mining operations at multiple mine sites <br />operated by Lafarge West, Inc. ("Lafarge" or "Applicant") along the South Platte River. This SWSP <br />proposes to replace depletions which occur at four different mine sites, specifically: 1) Howe Pit, M-78- <br />052 (WDID 0203009), 2) the Mann Lakes, M-82-147 (WDID 0203012), 3) the Fort Lupton Pit (Riverbend <br />West), M-85-088 (WDID 0203013) 4) Lupton Lakes (Riverbend East), M-04-078 (WDID 0203041). The <br />required fee of $1027 ($257x4) has been submitted. Lafarge previously operated Tanabe Pit (M-00- <br />002), Dunes Development (M-99-093), Riverbend Operation (M-00-016) and Stagecoach Stop Property <br />(M83-067) under the combined SWSP. The State Engineer approved the clay liner for the Tanabe Pit <br />and Dunes Development, which eliminated the need to replace new depletions from the evaporation of <br />exposed ground water. Because there are no longer lagged depletions that affect the stream from the <br />previously mined sites at Tanabe Pit and Dunes Development, you did not include these sites in the <br />SWSP. According to the information received on March 4, 2009 Lafarge sold the Stagecoach Stop <br />Property to Albert Frei and Sons in February 2009, therefore Lafarge will not make replacements for this <br />site after March 2009. The replacement requirement for this site beginning in April 2009 will be the <br />responsibility of Albert Frei and Sons. The Riverbend Operation has been taken out of this SWSP as <br />Lafarge does not anticipate mining or exposing ground water during the period of this SWSP. In addition <br />currently there is no ground water exposed at the Riverbend Operation site. <br />Lafarge transferred the Howe Pit to Denver Water in May 2009. Therefore, Denver Water will be <br />responsible for replacement of evaporative depletions at the Howe Pit site in the water year 2010. <br />Lafarge will batch concrete at the Howe Pit site. <br />As mentioned in the previous SWSP approval and based on previous information received <br />from the Applicant the Fort Lupton Pit site (M-85-088) is a "permitted reserve site" therefore <br />depending on the economic conditions mining may start anytime. <br />Office of the State Engineer <br />1313 Sherman Street, Suite 818 • Denver, CO 80203 • Phone: 303-866-35810 Fax: 303-866-3589 <br />www.water.state.co.us
