You have provided <br />a monthly breakdown of the annual depletions totaling 59.3 acre-feet of evaporative loss, 14.72 <br />acre-feet of water lost with mined product associated with 500,000 tons of aggregate, 6 acre- <br />feet of water used for dust control and 8.8 acre-feet of water used in concrete production to be <br />appropriated from the well permit no. 47856-F. Lafarge filed for water storage right for this site <br />in Case no. 98CW476. The site has been continuously dewatered at a rate of approximately <br />1200 gallons per minute. <br />The Greeley 35th Avenue Pit is located approximately 250 feet from the Cache La <br />Poudre River, thus depletions were not assumed to be instantaneous and have been lagged <br />back to the Cache La Poudre River. A stream depletion model using the Glover method was <br />used to calculate the lagged depletions to the Cache La Poudre River. The following <br />parameters were used in the model: transmissivity (T) = 120,000 gallons per day per foot, <br />specific yield (SY) 0.2, the distance from the Cache La Poudre River to the edge of the <br />alluvium = 5,000 feet, and the distance from the centroid of the exposed surface water areas to <br />the Cache La Poudre River = 250 feet. The total lagged mining depletions during the SWSP <br />period are 88.7 acre-feet. The total lagged depletions include the 8.8 acre-feet used for <br />concrete production from well permit no. 47856-F and 79.9 acre-feet from the othE'r <br />consumptive uses at the site. <br />Replacements <br />The source of replacement water will be from a lease 125 acre-feet of fully consumable <br />effluent water from the City of Greeley ("Greeley"). Lafarge traded its 550 Boyd and Freeman <br />Ditch shares for 125 acre-feet of augmentation water from Greeley. Fully consumable <br />replacement water is to be provided by Greeley and it will be returned to the river at one of the <br />following locations: a) Greeley Water Pollution Control Facility Outfall located on the Cache La <br />Poudre River; b) JBS Swift Industrial WWTP Outfall on Lone Tree Creek; c) confluence of the 35'h <br />Avenue Drainage Ditch and Cache La Poudre River or any augmentation station/release <br />structure(s) to be constructed in the vicinity of such confluence and associated with Greeley's <br />operation of reservoirs knows as Flatiron Reservoir Nos. 1-5 (a.k.a. Poudre Ponds or Greeley <br />West Pit); d) an augmentation station/release structure located under the Boyd and Freeman <br />Ditch and approved by the water commissioner and division engineer for such purpose; e) release <br />structures from Greeley Canal No. 3 as described in Greeley's decree in case no. 99CW232; or f? <br />any other release and measurement point that Greeley and Lafarge agree upon. The Applicant i;: <br />required to coordinate with the water commissioner the delivery location of replacement water to <br />ensure out-of-priority depletions are adequately replaced to prevent injury to other water rights, <br />Conveyance loss for delivery of augmentation water is subject to assessment and modification as <br />determined by the water commissioner or division engineer. A copy of the lease with the Greeley <br />was submitted to this office with the SWSP request and is attached to this letter. A monthly <br />breakdown of depletions and replacements is shown in the attached Table 3. <br />SWSP Conditions of Approval <br />I hereby approve the proposed substitute water supply plan in accordance with §37-90- <br />137(11), C.R.S. subject to the following conditions: <br />1. This plan is approved with the effective date of November 1, 2009 and shall be valid <br />through October 31, 2010 unless otherwise revoked or modified. If this plan will not be <br />made absolute by a water court action by the plan's expiration date, a renewal request <br />must be submitted to this office with the statutory fee of $257 no later than September 15, <br />2010.
