(Page 2) <br />MINE ID # OR PROSPECTING ID #: M-1976-056 <br />INSPECTION DATE: 10/27/09 INSPECTOR'S INITIALS: FCS <br />OBSERVATIONS <br />This was an acreage release/surety reduction inspection for the Riverside Pit, an activeI l2csand and gravel <br />permit operated by McAtee Construction, conducted by Eric Scott of DBMS. DRMS met Darren Gebhart of <br />McAtee Construction at their office at 220 Edwards Ave in Sterling Colorado at approximately 1000 on <br />October 27, 2009. Mr. Gebhart then took DRMS on a brief tour of the site to inspect the areas proposed for <br />release. The mining site identification sign was observed at the active site entrance. <br />The proposed release area was approximately 23 acres and consisted of the Lake Robert area which makes up <br />the eastern portion of the site, and the northern portion of Lake Marjorie. The Lake Robert area of the permit <br />has not been mined in at least several years. Several different kinds of vegetation have volunteered in this area <br />since mining has ended, however very little of it is consistent with the approved reclamation plan. Russian <br />olive trees will also need to be removed from the site before it can be released due to their classification as a <br />noxious species in the state of Colorado. Topsoil replacement and seeding consistent with the approved <br />reclamation plan will have to be completed, and vegetation established before the site will be eligible for <br />release. <br />Shoreline sloping will also have to meet the standards of Section 3.1.5(7) of the rule which states: all slopes, <br />unless otherwise approved by the Board or Office, shall be no steeper than a ratio of 2:1 (horizontal to vertical <br />ratio), except from 5 feet above to 10 feet below the expected water line where slopes shall be not steeper than <br />3:1. <br />It was also noted during the inspection that there were still material stockpiles and old equipment staged on the <br />area proposed for release. These items will have to be removed before a final release for the area could be <br />approved. Once an area is release from an active permit, it can no longer be impacted by ongoing activities in <br />the remaining permitted areas. <br />For the reasons listed above, the partial release request for the site will have to be denied. The basic <br />configuration of the site is acceptable, however the shoreline sloping, as well as topsoil and vegetation <br />requirements will have to be met before the site is eligible for release. <br />I & E Contact Address <br />Darren Gebhart <br />McAtee Construction <br />P.O.
