(Page 2) <br />MINE ID # OR PROSPECTING ID #: M-1999-058 <br />INSPECTION DATE: 10-27-09 INSPECTOR'S INITIALS GRM <br />OBSERVATIONS <br />This inspection is a compliance monitoring inspection by the Colorado Division of Reclamation, Mining and Safety. <br />Colorado Stone the operator of the Yule Quarry is working on stormwater and erosion control issues related to <br />violations (NOV) for failure to protect the hydrological balance and disturbing lands outside the approved affected <br />area. The purpose of the inspection is to note current conditions and temporary efforts made to correct the noted <br />NOVs prior to winter. The ground is now frozen and it is doubtful that any more surface construction can be done <br />beyond what has been accomplished. Measures noted are temporary. A comprehensive plan is being designed and <br />engineered over the winter so that permanent structures can be constructed next summer. <br />The inspector notes that temporary efforts appear to be in place to prevent most sedimentation from leaving the <br />permitted site. 100% containment may not be possible along the entire permit boundary until the marble slurry <br />dumped at the original dump area and been upper bench have been flushed out over the next few springs. However <br />it appears that all reasonable attempts have been made to prevent excursions. A short road has been extended just <br />outside the main portal to the southeast. The extension of the road provides a bench now that if maintained should <br />prevent most sedimentation from escaping down the slope of the disturbance area. Tall I "X 1" stakes painted bright <br />orange have been surveyed in along the waste rock piles where the road will switch back to a proposed lower level. <br />The primary sedimentation pond at the entrance to the quarry is noted as being cleaned out and holding some water. <br />As noted above sedimentation leaving the permitted area appears to have been abated. Colorado Stone has placed <br />hay bales and waddles on a steep slope below the point where sediment was being pushed over the edge as noted in <br />both 2007 and again in 2009. The temporary structures are at the permit boundary and helping prevent any further <br />sedimentation from migrating down slope. A large stone block has been placed at the push off point where the <br />missing barrier was noted. Signage has been placed in this area noting dumping is strictly prohibited. Although not <br />part of the permit, the operator has places delineator markers along key points of the access and haul road to prevent <br />snow removal damage to outlying areas. <br />The temporary measures are to be monitored on a regular basis. The inspector suggested that a log be kept to note <br />dates, times, structure conditions and any maintenance done over the winter.
