SCC indicated in the 8127 letter that Pond 11 will be modified for permanent stock pond use once it is no longer required <br />as a sedimentation pond (per landowner request), and that a permanent pond demonstration will be submitted at an <br />• appropriate time in the future. Documentation regarding this commitment needs to be incorporated into the permit <br />application package, and we request the following. <br />• Please revise Attacbment20-1 TOCpage to list "Pond 011" under Appendix 2042 "Permanent <br />Pond Demonstrations"listing. <br />Response: Attachment 20-1, TOC has been updated. <br />Please revise narrative on page 2044 under Sediment Ponds. to state that the "..... Yoast permit <br />area currently contains four (4) sedimentponds that will remain as permanent structures... ". <br />Response: The text has been revised. <br />• On the TOCpage for Appendix 20L1.2 "Permanent Pond Demonstrations" please list "Pond <br />011 with bulleted points indicating that the Permanent Pond Demonstration and the State <br />Engineer's Office approval for Pond 011 are yet to be completed ("TBC'). <br />Response: Appendix 20-1.2, TOC has been revised. <br />• <br />Seneca Coal Company • P.O.
