Mr. Peter Wayland <br />M2004-047-File Pit II <br />October 27, 2009 <br />Page 2 <br />through July 2010 the total stream depletions are estimated to be 19.38 acre-feet. The estimated <br />depletions are based upon groundwater evaporation, water in the mined product, and dust control. <br />There are 3.66 acre-feet of evaporative loss from 1.5 acres of water surface exposed at the site, 14.72 <br />acre-feet of water lost with the mined product associated with the mining of up to 500,000 tons of <br />aggregate and 1.00 acre-foot of water used for dust control. No groundwater will be used for concrete <br />production, reclamation, or any other purpose. <br />Replacements <br />The proposed source of replacement for this pit is 22.28 acre-feet of fully consumable water <br />leased from the City of Lafayette ("Lafayette") and made available at its wastewater treatment plant for <br />delivery to Boulder Creek via Coal Creek. Fully consumable and reusable water can be provided from <br />Lafayette's decreed water rights that contain fully consumable and reusable credits. A 15 percent river <br />transit loss is included in this amount. A copy of the Lafayette's lease was provided to this office with <br />this SWSP request and is attached to this letter. The term of the water lease is from August 1, 2009 <br />through July 31, 2010. The monthly depletions and replacement requirements are found on the attached <br />Table I. <br />Conditions of Approval <br />I hereby approve the proposed substitute water supply plan in accordance with §37-90-137(11), <br />C.R.S., subject to the following conditions: <br />1. This plan is approved with the effective date of August 20, 2009 and shall be valid through July <br />31, 2010 unless otherwise revoked or modified. If this plan will not be made absolute by a water <br />court action by the plan's expiration date, a renewal request must be submitted to this office with <br />the statutory fee (currently $257) by June 16, 2010. <br />2. Well permit no. 62145-F was obtained for the current use and exposed pond surface area of the <br />gravel pit in accordance with §37-90-137(2) and (11), C.R.S. <br />3. The water consumption and depletions associated with this mining operation must not exceed <br />those amounts listed on the attached Table I. <br />4. Approval of this plan is for the purposes as stated herein. Any additional uses of this water must <br />first be approved by this office. <br />5. All pumping for product washing, and dust control shall be measured in a manner acceptable to <br />the Division Engineer. <br />6. The name, address, and phone number of the contact person who will be responsible for the <br />operation and accounting of this plan must be provided on the accounting forms submitted to the <br />division engineer and the water commissioner. <br />7. All diversions shall be measured in a manner acceptable to the Division Engineer. The <br />Applicant shall install and maintain such measuring devices as required by the Division Engineer <br />for operation of this SWSP.
