Dear Mr. Seigmund: On August 27, 2009 the Division of Reclamation, Mining and Safety received your 112 Construction Materials Reclamation Permit Amendment Application package for the Spring Creek Gravel Pit, File No. M- 1994-097. A preliminary review of the information received determined that the application was missing a notice to the soil conservation district. On October 16, 2009 United / Old Castle submitted the notice and better maps. Staff has determined that the application is now complete and ready for review. Per Rule 1.4.8 the Decision date is set 90 days from the completeness date which is Januarv 19, 2009. Please be aware that if all issues are resolved prior to that date a decision may be rendered. If an objection to the amendment is received which cannot be resolved the matter will be scheduled for the February 2010 Mined Land Reclamation Board hearing at the earliest. Per Rule 1.6.2(d), the operator must start publication of the required public notice within 10 days of this letter for four (4) times, once a week, for consecutive weeks in a local newspaper. The end of the public comment period is 20 calendar days from the last date of publication of the notice. Please inform staff of the commencement of the public notice process, the final date of publication and the comment period end date. The required proof of publication must be sent in once the publication period has ended. Please note the submission of publication dates is important in helping staff schedule the review of the conversion.
