(Page 2) <br />MINE ID # OR PROSPECTING ID #: M-2005-006 <br />INSPECTION DATE: 10-20-09 INSPECTOR'S INITIALS GRM <br />OBSERVATIONS <br />This inspection was conducted as part of the Colorado Division of Reclamation, Mining and Safety (DRMS) <br />investigation of a possible disturbance outside the approved permit boundaries. The possible excursion was self <br />reported by Moffat County. The Powder Wash No. 66 is a 112c permitted site located off County Road 66 in <br />northern Moffat County. Marvin Moore representative for Moffat County accompanied the inspector on site. <br />The mine identification sign and affected area boundary markers are in place and in compliance with Rule 3.1.12. <br />The sign is located at the entrance to the site where it enters the permit boundary. Permit boundaries are marked by <br />signs that clearly state "permit boundary" and t-post that are located at key corners and along de-linear lines as <br />needed. <br />As reported in June of 2009 Moffat County is just beginning to develop this site. Topsoil has been stripped and <br />stockpiled on the north end of the permit area. It appears that overburden is now being stripped and stockpiled along <br />the east side of the disturbance area. A culvert for the drainage is installed at the south end of the drainage where the <br />haul road crosses over. The installation appears to be adequate at this time. <br />Moffat County contacted DRMS regarding the construction of the main access into the pit area. The plan calls for <br />the entrance at the south end to come off of County Road 66 parallel and inside the permit boundaries and swing to <br />the east. During construction, field personnel came directly off the road farther south which cuts across <br />approximately 100 feet of unpermitted lands. The portion of the road off the permit boundary is 100 feet long by 30 <br />feet wide or approximately 0.07 acres. While the disturbance is small it appears to be failure to protect areas outside <br />the permit boundaries and a "Reason to Believe" letter will be issued. Moffat County has indicated that they will <br />begin the amendment process as quickly as possible to bring the disturbance area into the permit which will correct <br />the issue.
