DRMS CEMEX M1977-208 Quarterly Report Y09Q02 <br />10/20/2009 <br />Page 2/4 <br />CEMEX continues to monitor the water elevation in the C-Pit pond visually; the data logger <br />recording head data became submerged under slumping shale and clay and was removed from <br />the pit in June 2009. The kiln, and hence the cooling water tower, has been shut down from <br />December 2008 to April 24, 2009, June 28 to August 10, and again from September 7 to October <br />7, 2009. Pumping occurred intermittently for cooling water between April 2009 and October 7, <br />2009. Re-evaluation of water levels in the third quarter of 2009 revealed that the level rose <br />approximately three feet over the two quarters. Albiet this limited pumping, ditch leakage, and <br />the extremely wet season, CEMEX has reduced the water surface area remaining in C-Pit down <br />to approximately a quarter acre. <br />There has been in-flow of water through the west high wall in C-Pit in this quarter. Water was <br />present in some of the pieziometers placed between the canal and C-Pit, but none was present <br />between the Sweede Ditch and the pit. Based on these and other observations, it is evident the <br />majority of the source of the water into the C-Pit is from the loss of lining at the northern bend in <br />the irrigation ditch. We will begin to explore options in this non-irrigation season to work with <br />Northern Colorado to reline this portion of the ditch. Lower portions of the ditch were lined in <br />prior seasons. <br />No seeps or springs down gradient of C-Pit have been observed. As agreed upon in TR-9, we <br />will continue to monitor for the presence of seeps or springs. <br />CEMEX appreciates the opportunity to meet with the Division on October 14 and review the <br />goals of this monitoring program in order to establish the most prudent course of actions. <br />Pursuant to that meeting, CEMEX will submit a TR11 to address short term monitoring changes, <br />and TR12 by the end of the first quarter of 2010 to summarize the information and data collected <br />to date and develop a long term groundwater protection and monitoring program which will <br />include the results of discussions with Northern Colorado and closure of CEM005.
