In order to restore irrigation return flow from Petrocco Farms, the operator will construct two lined <br />ditches that will transport the irrigation water under Brighton Road directly to the McCann Ditch. <br />One will be installed along the southern boundary of the permit area. Currently, there is a ditch in <br />place at this location that carries water to the southwest portion of the proposed mining area. <br />However, the water is not carried directly into the McCann Ditch, it disperses over a hillside above <br />the McCann Ditch and some of the water finds its way into the McCann Ditch. A second lined <br />ditch will be constructed that will bisect the middle of the proposed mining area. This ditch will carry <br />the irrigation water under Brighton Road near the intersection of East 144 Avenue directly to the <br />McCann Ditch. The Division believes these two ditches will significantly improve the return flow of <br />irrigation water to the McCann Ditch. <br />In conclusion, the Division believes the operator has developed a plan that will protect and perhaps <br />even improve the surface and ground water regime that supplies the McCann Ditch with water. <br />Division Comment <br />The Division believes that the applicant has addressed the concerns of the objector. <br />III. DIVISION RECOMMENDATION <br />It is the recommendation of the Office to approve the 112c permit amendment application for the <br />Bromley Lakes Pit (M-1987-049) over the objection with the following stipulation. <br />Stipulation #1: <br />1.) Ready Mixed Concrete Company shall not disturb the McCanne Ditch and land within 200 feet <br />of the McCann Ditch until they have submitted and received approval from the Division of a <br />Technical Revision with plans for the French Drain System. The Technical Revision shall contain <br />engineering plans and details about the location of the French Drain System that will be installed <br />to transmit groundwater to the ditch to restore the groundwater regime supplying the ditch. Also, <br />the operator will need to post sufficient financial warranty to cover the cost of the instillation of <br />the French Drain System. <br />OR <br />The operator will need to submit and receive approval of a Technical Revision showing the French <br />Drain System in not necessary. <br />4
