III. COMMENTS -COMPLIANCE <br /> Below are comments on the inspection. The comments include discussion of observations made <br /> during the inspection. Comments also describe any enforcement actions taken during the inspection <br /> and the facts or evidence supporting the enforcement action. <br /> This was a partial inspection conducted by Kent Gorham of the Colorado Division of <br /> Reclamation, Mining, and Safety (Division). The New Elk mine has been closed since the <br /> early 1980's and sealed since about 1989. The new operator, New Elk Coal Company LLC <br /> has plans to re-enter the underground workings for potential re-development of the Allen coal <br /> seam and possible new development of other coal resources in the immediate area Ground <br /> conditions on this day were dry. The weather was clear and mild. <br /> Hydrologic Balance <br /> Pond 4 at the Development <br /> Waste Pile (DWP) remains <br /> dry. Pond 7 (at right) = <br /> remains nearly full and should <br /> be manually discharged in the e <br /> nearfuture. Thefive <br /> containments at this site <br /> remain dry. Underground <br /> mine water was being <br /> discharged to Pond 001 on <br /> the 19' but the pond was not <br /> discharging. <br /> Backfilling and Grading <br /> The operator recently <br /> received approval of Technical Revision No. 51 (TR-51) to excavated an area at the West <br /> Mine to repair the roof of an incline slope some 35 feet below the surface (shown at left <br /> below). The incline slope was the location of a prior mine collapse 3-4 years ago that was <br /> final repaired after initial unsuccessful attempts. The excavated material is piled immediately <br /> to the north of the hole (shown at right below). <br /> .-,"M. <br /> 3 <br />
