(Page 2) <br />MINE ID # OR PROSPECTING ID # M-1988-057 <br />INSPECTION DATE 9/18/09 <br />OBSERVATIONS <br />INSPECTOR'S INITIALS WHE <br />This inspection occurred as part of the Division's review process for Technical Revision No. 1 (TR-01) and as <br />follow-up to Surety Increase No. 2 (SI-02), increasing the financial warranty from $1,974 to $9,319. The permit is <br />approved for five acres affected land. This report is accompanied by the Division's questionnaire, "Need For State <br />Reclamation Permit", seven photos and an updated reclamation cost estimation totaling $1,980. <br />Under TR-01 the Operator requested that portions of the affected lands be stabilized with gravel surface forvehicle <br />parking. The Operator also requested that the massive rock platform for the crusher and rock works located at the <br />north end of the pond be approved as permanent structures. The rock platform and rock works at the north end of <br />the pond had been constructed from large angular rock, tightly fitted, and appeared stable. On September 29, <br />2009, the Division approved TR-01. <br />As shown in the photos, a pond, approximately four acres in surface area, has resulted from the mining operation. <br />Permit documents include correspondence from the Office of the State Engineer, Division of Water Resources, <br />which indicate that the Operator has acquired well permit 61272-F and a Substitute Water Supply Plan for the pond. <br />Pond slopes have been stabilized with riprap. The mining operation is in its final stages and limited to the island in <br />the pond. Remaining reclamation appears limited to minor grading and minor revegetation. The pond is bordered <br />on the east by an historic flood protection dike for Devil Creek. Portions of the historic dike have been restored by <br />the Operator. All portions of the dike appeared well constructed, massive, and stabilized with riprap and vegetative <br />cover. No evidence of slumping, sliding or excessive erosion was observed for the dike or any of the pond slopes. <br />A large, open channel spillway is located at the southwest corner of the pond and will direct flood flow to the historic <br />floodplain of Devil Creek. A small sediment pond is located immediately south of the large pond, which outlets to <br />Devil Creek. At the north end of the pond the Operator has constructed massive rock works for the purpose of <br />recreation and artistic expression. <br />The rock platform for the crusher and the rock works located at the north end of the pond were constructed from <br />large angular rock, which exhibited freshly fractured surfaces. Such rock appeared inconsistent with the weathered, <br />sub-rounded to rounded, rock typically deposited by alluvial processes. The permit area is located entirely within <br />the historic floodplain of Devil Creek and an unlikely source for large angular rock with freshly fractured faces. A <br />small excavation was located approximately 1000 feet south of the permit area and beyond the east floodplain of <br />Devil Creek. As shown in the photo, the unpermitted excavation site appears to be a likely source for the large <br />angular rock with freshly fractured surfaces utilized to construct the rock platform and rock works located at the <br />north end of the pond. Please note that if the Landowner is utilizing the rock from this unpermitted excavation <br />entirely for use on his land then a reclamation permit might not be required for the excavation site. However, if any <br />of the materials from the unpermitted excavation are transported off site, then a reclamation permit is required. <br />Please provide the information requested in the enclosed questionnaire, "Need For State Reclamation Permit". <br />The Division has reviewed the current cost of reclamation totaling $1,980.
