PROBLEMS/POSSIBLE VIOLATIONS AND CORRECTIVE ACTIONS CORRECTION DATE 1 Tl e Operator has not demonstrated a legal right to expose groundwater or store water in the pond created by the mining activity. CORRECTIVE ACTION: Within 30 days of the signature date of this report, by, November 16, 2009, demonstrate compliance with Rule 3.1.6(1)(a), by providing co0y of a valid well permit and proof of a water storage right. If, by November 16, 2009, the Operator has not demonstrated compliance with Rule 3.1.6(1)(a), the Division will increase the amount of financial warranty required for the operation sufficient to address backfilling of the pond and thereby ensure compliance with Rule 3.1.6(1)(a).
