Subject: Twentymile Coal Company-Foidel Creek Mine-Permit Revision-08
The Fish and Wildlife Service (Service) has reviewed your June 9, 2009, letter regarding the
subject permit revision. Twentymile Coal Company's Foidel Creek mine occurs about 22 miles
southwest of Steamboat Springs, Routt County, Colorado. The proposed permit revision would
extend underground longwall coal mining into a Federal Lease area (COC-72980) at a rate of
10-12 million tons/year.
Water depletion impacts to the four endangered Colorado River fishes and their critical habitat
have been addressed previously in biological opinions GJ-6-CO-95-F-007 and
GJ-6-CO-97-F-014 and depletion amounts will not be exceeded from the proposed rates of .,
mining. Consequently, although we concur with your "may affect, likely to adversely affect"
determination for impacts to the endangered fishes, no further consultation is necessary.
Concurrence is not required for "no effect" determinations for the other species addressed in
your letter.
