III. COMMENTS-COMPLIANCE <br /> Below are comments on the inspection. The comments include discussion of observations made during the <br /> inspection. Comments also describe any enforcement actions taken during the inspection and the facts or <br /> evidence supporting the enforcement action. <br /> 1 channel (Photo#485). Upon re-inspection on August 12, 2009, the remnant scraper route and <br /> topsoil berm had been properly graded out and the re-disturbance areas had been seeded,but the <br /> areas of minor hillslope erosion down-slope of the volunteer aspen patch and adjacent to the <br /> upper segment of Channel PM 1-1 had not yet been stabilized. The hillslope gully features in <br /> the upper YPM 1-1 watershed will need to be stabilized in accordance with the Rill and <br /> Gully Plan of the approved permit. <br /> Mr. Patrick had also mentioned a concern with weeds in the vicinity of the volunteer aspens. <br /> Although a diverse stand of seeded perennial vegetation is becoming established in the upper <br /> portions of the YPM 1-1 watershed (Photo#477),there is a significant presence of the noxious <br /> weed Canada thistle in the immediate vicinity of the aspen patch(Photo#478). The thistle <br /> patch will need to be treated in accordance with the weed control plan of the approved <br /> permit. <br /> Further down along the YPM 1-1 watershed, a hillslope gully was noted along the north <br /> boundary of Shrub Plot SP06-1, continuing for a distance parallel to the permanent channel. The <br /> gully warrants maintenance/stabilization in accordance with the approved Rill and Gully Plan <br /> (Photos #489/492/493). An old settling crack with maximum displacement of 12-15 inches was <br /> observed on the east facing slope a short distance to the north of Shrub Plot SP06-1. The crack <br /> and small slump feature associated appear to have stabilized, and seeded vegetation is well <br /> established(Photo#491). No remedial action appears to be warranted at this time. The YPM <br /> 1-1 channel itself appeared stable along its length down to Stock Pond ST-1. Minor rilling was <br /> present along the west bank of the channel, apparently associated with runoff concentrated along <br /> a maintenance route(Photo#496). Installation of a series of small water bars or similar <br /> maintenance measures to route flow into the channel appear to be warranted. Stock Pond ST-1 <br /> contained a shallow puddle; the embankment has not yet been topsoiled and rills have developed. <br /> The embankment needs to be topsoiled and seeded. ST-1 was not included in the SL-2 release <br /> request area. <br /> YPM 5-1 Drainage <br /> YPM 5-1 Channel was walked beginning at its lower end at the inlet to recently constructed <br /> Sedimentation Pond 012A. Pond 012A and its immediate vicinity, including YPM 6-2, YPM 6- <br /> 3, Sedimentation Pond 012 and slope failure area north and east of Pond 012 were not included <br /> in the SL-2 release request. YPM 5-1 and its watershed upstream of Pond 012 were included in <br /> 7 <br />
