III. COMMENTS-COMPLIANCE <br /> Below are comments on the inspection. The comments include discussion of observations made during the <br /> inspection. Comments also describe any enforcement actions taken during the inspection and the facts or <br /> evidence supporting the enforcement action. <br /> structure based on written documentation from YVEA, included in Tab 20 of the Yoast permit <br /> application package. The power line corridor is included in the SL-2 release request area. <br /> Most of the North Pit Area west of the drainage divide was approved for Phase 1 bond release in <br /> SL-I. Exceptions were a section of upper YPM-10, which required regrading and improved <br /> riprap distribution, a temporary light use road that ran along the north edge of YPM-10, and a <br /> long gully which ran along the southern boundary of the North Pit area from the watershed divide <br /> down to Armand Draw. Narrow corridors associated with these features were excluded from the <br /> Division's SL-1 approval decision. The light use road segment was properly reclaimed, with the <br /> exception of a short lower segment that was subsequently approved as a postmining road (LU2). <br /> The remainder of the light use road was properly reclaimed, as verified during the SL-2 <br /> inspection (see previous discussion under"Roads"of this SL-2 inspection report). The entire <br /> length of the YPM-10 channel was walked during the SL-2 inspection, numerous grade checks <br /> were made, and no problems were observed. The channel was stable along its length and <br /> appeared to be consistent with approved design, including the segment that was excluded from <br /> the SL-1 approval. Photo MLT716427 shows a portion of the channel reach that was excluded <br /> from the SL-1 approval; to the right side of the reclaimed light use road corridor. A gully was <br /> noted during the SL-2 inspection, that extends up-slope and to the south from the upper end of <br /> Channel YPM-10 (Photo MLT716444). The erosion apparently resulted from concentration of <br /> flow along a previously reclaimed scraper route. This gully is considered a maintenance item <br /> and will need to be stabilized by the operator in accordance with the Rill and Gully plan of <br /> the approved permit. <br /> Channels YPM-21 and its tributaries YPM-21 A and YPM-21 B were constructed subsequent to <br /> the 2007 SL-1 bond release. These permanent channels were constructed along the length of <br /> gully features that had been noted in the SL-1 inspection. The gullies that were noted where <br /> YPM-21 and YPM-21B are now located were excluded by the Division from the SL-1 approval. <br /> Due to time constraints, these channels were not closely observed during the July SL-2 <br /> inspection, but they were walked during the Division's inspection of June 16, 2009. YPM-21 <br /> was noted to include a steep riprapped segment along its lower end, with TRM lining along the <br /> lower gradient upper segment, extending to the confluence of YPM-21A and YPM-21B. YPM- <br /> 21 was stable along its length and appeared to be in conformance with design specifications. <br /> YPM-21A and YPM-21B were noted to be stable TRM lined channels along their entire lengths, <br /> in apparent conformance with approved design. An intermittent gully was observed that was up <br /> to 12" deep and extended from near the upper end of YPM-21 B up to its apparent source in a <br /> roughened shrub planting area. Low impact hand-crew stabilization measures are warranted <br /> for this gully,in accordance with the Rill and Gully plan of the approved permit. <br /> 5 <br />
