III. COMMENTS-COMPLIANCE Below are comments on the inspection. The comments include discussion of observations made during the inspection. Comments also describe any enforcement actions taken during the inspection and the facts or evidence supporting the enforcement action. Phase 1 Bond Release Reclamation Success Summary Based on site inspection, the reclaimed areas included within the SL-2 bond release request (delineated on SL-2 Map Exhibit A) appear to have been restored to the approximate original contour of the pre-mining landscape. Slopes are in general conformance with approved post- mining contours as shown on the Postmining Topography Map of the approved permit (Exhibit 20-2) and appear to be stable. Reconstructed drainages within the release request area are for the most part in good condition, with only a few exceptions noted where significant further work is required (e.g. lower YPM-7), or where past erosion has been severe and the Division feels that Phase 1 bond release would not be prudent at this time (e.g. the YPM-8 watershed). Minor hillslope; erosion and minor channel erosion was noted in a number of locations,but the extent and nature of the erosion observed in most locations was within the context of"maintenance items"to be addressed in the context of the Rill and Gully Plan of the approved permit. A significant amount of progress had been made with respect to such maintenance prior to the Division's August inspection. A few locations as described in the Backfill and Grading section of this report will be excluded from the Division's proposed approval decision for SL-2, due to erosional concerns and/or due to the extent of on-going or future reclamation activity that will potentially impact the locations. One area, the slopes and drainages in the Pond 011A watershed of the North Pit, was not inspected during the SL-2 inspection. The area will be inspected prior to issuance of a proposed decision for SL-2. 18
