III. COMMENTS - COMPLIANCE <br /> Below are comments on the inspection. The comments include discussion of observations made <br /> during the inspection. Comments also describe any enforcement actions taken during the inspection <br /> and the facts or evidence supporting the enforcement action. <br /> This was a partial coal inspection conducted by Jason Musick of the Colorado Division of <br /> Reclamation, Mining, and Safety(Division) on 05 October 2009. The weather was cloudy and <br /> snowing and the ground was wet during the on-the-ground inspection of the site. <br /> Roads <br /> The Old Tipple Road, North Road, Lower Moffat Road, Center Ridge Pond Road, West Ridge Pond <br /> Road, and West Ridge were wet and stable at the time of the inspection. Roadside ditches were in <br /> good condition and stable with no problems noted. <br /> Hydrologic Balance <br /> The Moffat Pond was holding clear water with a light trickle discharge noted. The embankments were <br /> stable and well vegetated with no problems noted. The primary spillway was functioning as permitted <br /> and the emergency spillway was in compliance with no evidence of damage and no problems noted. <br /> The Center Ridge pond was holding water and discharging at the time of the inspection. The <br /> embankments appeared stable and in compliance at the time of the inspection the primary spillway <br /> was functioning as permitted and the emergency spillway was in good condition with no problems <br /> noted. <br /> The West Ridge Pond was holding water with no discharge noted at the time of the inspection. The <br /> lower cell of the West Ridge Pond was dry at the time of the inspection. The embankments were <br /> stable and well vegetated with no problems noted. The primary and emergency spillways were in <br /> good condition with no problems noted. <br /> The permanent diversion ditch from the West Ridge Pond to the Center Ridge Pond contained water <br /> and was discharging with the Center Ridge Pond. The 007 discharge flume located between the <br /> Center Ridge Pond and Trout Creek was unreadable with a trickle discharge. <br /> The Moffat down drains 1 —4 and the Moffat Final Pit Segment Ditches were in good condition and <br /> stable with no problems noted. No water was observed flowing in the drains or ditches at the time of <br /> the inspections. <br /> The string-of-pearls permanent drainage channel contained water at check dams 11 and 12. No <br /> problems were noted and the drainage appears to be functioning as designed. <br /> The North Road culverts E1 — E5, and E12, Lower Moffat Road culverts E6 — E8, MAC8, and MAC3 <br /> were in good condition and functioning as designed. The inlets and outlets showed no signs of <br /> damage, erosion or blockage of the culverts. <br /> Revegetation <br /> The areas of the mine site that have been revegetated show good signs of substantial vegetative <br /> cover. A bond release inspection conducted in August 2009 showed evidence of scotch thistle, <br /> Canada thistle, houndstounge, and perennial pepperweed along the roads and small patches <br /> throughout the reclaimed areas of west ridge and Moffat areas.
