Construction of the foundation for an emergency generator was underway at the time of <br /> inspection. The generator will supply power to the mine ventilation system in the event of a <br /> power outage. <br /> Scott informed us that the mine has its explosives permit again. Explosive magazines are stored <br /> in a container near DP-1. <br /> B vent shaft 41 is fenced and marked. B vent shaft#3 is still under construction (see Figure 6). <br /> The casing is to be set in concrete. A crane is scheduled to arrive on Friday to complete this <br /> work. The shaft is labeled as dangerous but not yet fenced (fencing material on ground near site, <br /> to be fenced upon completion). <br /> RP-23 is a three-cell pond system. Upper cells receive most of the sediment. Water is pumped <br /> down to the lower cell when necessary to clean upper cells. At the time of inspection the lower <br /> cell was dry and the upper cells contained water and were not discharging (see Figures 7 & 8). <br /> Coal fines sediment in ponds but not in outlet channel indicates sedimentation ponds are <br /> functioning as designed. <br /> RP-1 was dry at the time of inspection. RP-4 contained very little water. SS-1 and SS-2 were dry <br /> at the time of inspection. <br /> Records review: By letter dated July 30, 2009 the second quarter sediment pond inspection <br /> report was certified by William Lepro. Minor problems to be addressed with the DP-1 discharge <br /> structure and enhancements to the emergency spillway (to better serve the intent of the design) <br /> were noted. <br /> The 2008 Annual Reclamation Report dated February 12, 2009 reported total disturbed acreage <br /> as 445.31 (5.97 ac for 2008), acres backfilled and graded as 124.25 (3.37 ac for 2008), acres <br /> topsoiled as 124.25 (3.37 ac for 2008), acres seeded as 105.71 (4.02 ac for 2008). The interim <br /> drill site seed mix was used. <br /> The 241h annual hydrology report for October 2007— September 2008 was on file. It included <br /> well and water usage information and all surface and groundwater monitoring reports. <br /> The DRMS permit is current with renewal 45 processed in June of 2009. Bond is current at <br /> ($5,630,311). Explosives permit 45-CO-103-33-2G-00657 for the use of high explosives expires <br /> July 1, 2012. CDPS general (storm water) permit COG-850000 expires 06/30/2013.NPDES <br /> permit 4CO-0038024 expires 09/30/2012. No MSHA ponds are on site. Special use permit(to <br /> mine coal in Rio Blanco) ID # 00-43 is current. SPCC plan dated 03/18/2008 was on file. Water <br /> well permit numbers 279067, 279068, 279069 from 10/28/2008 are on file. <br /> Additional notes: No disturbed area markers were observed on site. We discussed the <br /> interpretation of the marker rules. Jason stated that the intent of the rule is to differentiate on the <br /> ground what disturbance is approved in the permit. This facilitates his inspection responsibilities. <br /> Scott stated that the intent of the rule is to delineate what is approved for disturbance to aid <br /> construction crews, and that these markers may be removed after construction is complete.
