Box 1 175 Longmont, Co 80502-1 1 75 Phone 303-774-0173 Fax 303-774-0173 VecchiAssociates@comcast.net <br />September 16, 2008 <br />Dana Christiansen <br />12269 CR 64 %2 <br />Greeley, CO 80631 <br />RE: Parsons Mine - Structures Agreement <br />Dear Dana: <br />I am writing on behalf of Lafarge West, Inc. regarding the Parsons Mine application for <br />sand and gravel mining located south of County Road 64 % adjacent to your property. <br />Lafarge West, Inc. is in the process of permitting the Parsons Mine through the Division <br />of Reclamation, Mining and Safety (DRMS) and Weld County. As part of the <br />entitlement process,( Section 6.3.12 Mineral Rules and Regulations of the Colorado <br />Mined Land Reclamation Board for Extraction of Construction Materials - Exhibit L - <br />Permanent Man-Made Structures), the DRMS requires the following: <br />"Where the mining operation will adversely affect the stability of any significant, <br />valuable and permanent man-made structure located within two hundred (200) feet of the <br />affected land, the Applicant shall either. <br />(a) Provide a notarized agreement between the Applicant and the Person(s) <br />having an interest in the structure, that the Applicant is to provide <br />compensation for any damage to the structure; <br />or <br />(b) Where such an agreement cannot be reached, the Applicant shall provide an <br />appropriate engineering evaluation that demonstrates that such structure shall <br />not be damaged by activities occurring at the mining operation." <br />Item (b) refers to the Stability Analysis for the Parsons Mine that has been completed and <br />is enclosed herein. In total, I have attached the following documents for your review: <br />• Two original documents entitled "AGREEMENT TO MINE WITHIN 200 FEET <br />OF PERMANENT MANMADE STRUCTURES". <br />• A copy of the slope Stability Analysis for the Parson's Mine prepared by Deere <br />and Ault Consultants, Inc.; <br />• A 24 in. x 36 in. map identifying the location of structures within the overall <br />project; <br />• An overall project Mining (Extraction) Map <br />• An overall project Reclamation Plan Map
