EXHIBIT S <br />Permanent Man-Made Structures within 200 Feet of the Affected Land <br />Following is a table listing all man-made structures located inside and within 200 feet of the <br />affected land. Additionally, please refer to Sheet 2 of Exhibit C which depicts the location of each <br />structure. A Slope Stability Analysis was prepared for the Parsons Mine to determine the <br />recommended setback from the mining operations to the structures. As you will see on the <br />attached table, the recommended setback has been met or exceeded for all of the man-made <br />structures within 200 feet of each mining cell. <br />We are currently working to obtain a Structure Agreement with each of the structure owners listed <br />in the attached table. A summary of the status of Structure Agreements, as well as copies of the <br />currently signed agreements and proof of notice for some of the agreements is attached. Copies of <br />the in-process agreements will be forwarded to the DRMS as they are executed. <br />In addition, attached you will also find a copy of a signed agreement between Kinder Morgan, <br />Lafarge West, Inc. and Livingston Leigh Livestock of Weld County, LLC. This agreement shifts <br />the location of a pipeline easement that traversed the Livingston Leigh Livestock of Weld County, <br />LLC property along the west edge of County Road 25. Kinder Morgan does not yet have a pipeline <br />within any portion of the old or new easement; therefore, we do not need a Structure Agreement <br />with Kinder Morgan. <br />Parsons Mine <br />DRMS 112 Reclamation Permit Application <br />Page SI of S3
