This permit is being submitted on behalf of Lafarge West, Inc. in care of Anne <br />Johnson. As you are aware, a DRMS 112 Reclamation Permit Application for the <br />Parsons Mine was originally submitted for review in December 2007. However, the <br />application was withdrawn prior to expiration of the review period, thus necessitating <br />submittal of a new application. Therefore, within this new application, we have <br />addressed and incorporated responses to the Adequacy Review comments that we <br />received regarding the original application. We anticipate that this effort will aid in your <br />review. <br />When we met with you in May 2009 regarding the original application and the Adequacy <br />Review comments, there were a couple of issues that you asked us to clarify. We have <br />done so in our application; however, we wanted to bring them to your attention here as <br />well: <br />1. In Exhibit S, we have included a copy of the signed agreement between Kinder <br />Morgan, Lafarge West, Inc. and Livingston Leigh Livestock of Weld County, <br />LLC. This agreement shifts the location of the original easement that traverses <br />the property along the west edge of County Road 25. The Kinder Morgan <br />pipeline has not yet been constructed in this area. Therefore, we do not have a <br />Structure Agreement with Kinder Morgan. <br />2. We are currently working to obtain Structure Agreements with all of the structure <br />owners within 200 feet of the mining boundary. A summary of the status of <br />Structure Agreements, as well as copies of all currently signed agreements and <br />proof of notice for agreements, is included in Exhibit S. We will continue to <br />forward copies of the remaining agreements as they are executed. In addition, an
