Cattany <br />Division Director <br />Natural Resource Trustee <br />Re: 32.5 Road Gravel Pit, File No. M-2009,935, 112c Construction Materials Reclamation Permit Application <br />Package, Second Adequacy Review. <br />Dear Mr. Azcarraga: <br />The Division of Reclamation, Mining and Safety has begun the review process for the above referenced 112 amended <br />application. The project appears to be a straight forward request to permit a construction materials operation. A <br />review of the application has revealed a few clarifications and issues that need to be addressed. <br />1. EXHIBIT D - Mining Plan (Rule 6.4.4): Please provide clarification for the following items: <br />In Exhibit D, under Typical Sequence of Operation, Item (2), it is stated that "The area to be <br />stripped topsoil area will be no larger than 4 acres in size at one time. The total volume of <br />stockpiled topsoil for the entire site includes approximately 24,000 cubic yards." Please <br />explain/clarify how a total volume of 24,000cubic yards will be stockpiled if only 4 acres is to <br />be disturbed at one time. Does the estimated 4 acres of disturbance include the operations roads <br />and process areas? Please clarify the maximum disturbance at any given time during the <br />operation. <br />• On page 10 in the application, paragraph 3, it is stated that "the settlement ponds will allow the <br />sediment to drop out of the water before it is discharged off site into the 33 Road ditch." Please <br />provide proof that the operator has permission to use the mentioned water conveying structure. <br />2. EXHIBIT E - Reclamation Plan (Rule 6.4.5): Please provide clarification for the following item: <br />• On page 13 in the reclamation plan, paragraph 3, it is stated that "Seeding operations should be <br />scheduled to occur in early April or late August." To aid in revegetative success, it is better to <br />conduct the fall seeding in late October/early November. <br />3. Special Provisions - 112 Reclamation Permit Application (Rule 1.6.5): Please provide clarification <br />for the following item: <br />• Proof of publication was submitted to the office on October 14, 2009. The date <br />indicated on the publication for final comment is December 14, 2009, which is the <br />decision date for the application.
