Cattany <br />Division Director <br />Natural Resource Trustee <br />The Division of Reclamation Mining and Safety (DRMS) has finished the review of Montrose County's <br />112c application referenced above. It appears that Lewicki and Associates responses to the DRMS <br />Preliminary Adequacy Review (PAR) of the above referenced 112c application meet the requirements of <br />the Act and Rules. A Pre-operational inspection was conducted on September 23, 2009. No additional <br />issues were noted based on that inspection. It appears all issues have been addressed and no <br />comments were received by the close of the public comment period of October 7, 2009. Therefore, <br />staff is pleased to inform Lewicki and Associates and Montrose County that the application is approved. <br />Per Rule 4.1.2(2) no financial warranty is required to be posted by the County. However a Performance <br />Warranty is required. The required warranty is being forwarded from the DRMS Denver Office to <br />Montrose County for signatures and return.
