Cattany <br />Division Director <br />Denver, CO 80203 Natural Resource Trustee <br />RE: Exposed Ground Water at a Mining Operation, <br />Response to September 22,,2009 Comments from OSE, <br />Mask Ranch Gravel Pit,- ermit No. M-2002-087. <br />Dear Ms. Frey: <br />On September 22, 2009, DRMS received your response to our notice regarding a request for release of <br />warranties and termination of the Mask Ranch Gravel Pit permit. Please find enclosed copy of the <br />inspection report resulting from the Operator's request for termination of permit. <br />As noted in the enclosed inspection report, the operation has exposed ground water and is diverting flow <br />from the San Juan River. DRMS has imposed a 30 day deadline whereby the Operator must demonstrate <br />compliance with Colorado water laws and regulations governing injury to water rights, as required by <br />Construction Materials Rule 3.1.6(1)(a). <br />Thank you for responding to DRMS's notice.
