Cattany <br />Division Director <br />Natural Resource Trustee <br />On September 18, 2009, the Division of Reclamation, Mining and Safety (Division) inspected the above <br />referenced operation in response to your request for full release of warranties and termination of permit <br />(SL-01). Please find enclosed, copy of the inspection report generated from that inspection. <br />As noted in the enclosed inspection report, on October 15, 2009, the Division denied SL-01. The Division's <br />decision to deny SL-01 was based on the fact that reclamation had not been completed in accordance <br />with permit conditions and the Act and Rules. <br />The Division has imposed a 30 day deadline, by November 16, 2009, whereby the Operator must <br />demonstrate compliance with Rule 3.1.6(1)(x). If, by November 16, 2009, the Operator has not <br />demonstrated compliance with Rule 3.1.6(1)(a), the Division shall increase the amount of financial <br />warranty required for the operation sufficient to address backfilling of the pond and thereby ensure <br />compliance with Rule 3.1.6(1)(a). <br />Please contact me at the Division's office in Durango at 691 County Road 233, Suite A-2, Durango, <br />Colorado 81301, phone (970) 247-5469, if you have any questions. <br />Sincer, <br />Wallace H.
