On behalf of Bowie Resources, LLC, following are its <br />responses to the DBMS' comments and concerns. <br />1. DRMS - Please submit copies of the APCD Cancellation letter for each of the <br />four Emission Permits to the Division for inclusion in Exhibit 10 of Permit Volume <br />7. <br />BRL - Enclosed is a letter dated September 5, 2008 from the Air Pollution <br />Control Division that confirms the four emission permits have been cancelled. <br />The letter should be inserted into Exhibit 10 of permit volume 7. <br />2. DRMS - Please specify the water right(s) that will be used to irrigate the cropland <br />areas at the Loadout Facility, or direct the Division to the location of the <br />information, if it may already be found in the Permit. <br />BRL - The land will be irrigated from the Fire Control Pump House shown on <br />Map-7. The pond that feeds the pump house derives its water from the Pavka <br />Spring No. 1 owned by BRL. Enclosed is a document that verifies Bowie owns <br />the Pavka Spring No. 1. The Pavka Spring No. 1 is map code no. 9 on Map 9. <br />The ownership verification document should be inserted in Exhibit 1 of permit <br />Volume 7. <br />3. DRMS - The last paragraph on Page 2.05-27describes measures proposed to be <br />used to determine the success of revegetation. Portions of Rule 4.15.9 are <br />transcribed, but the subject of the period of liability is ambiguous. In order to
