-3- <br />adequacy of environmental protection facility design, maintenance and operation. Where surface water <br />samples are not available during the specified time period due to climatic condition, the DRMS must be <br />contacted so that other alternatives may be agreed upon. <br />(c) Analytical detection limits for surface water must be acceptable to the DRMS for surface water quality <br />parameters in consultation with the Water Quality Control Division. <br />The application will not be considered filed until the information listed above is received and found sufficient to <br />begin the DRMS technical review. At the time the responses to this letter are provided to DRMS, Venture <br />Resources must place copies of the response documents and of this letter for the public to view with the Clear <br />Creek County Clerk and Recorder and provide an affidavit or receipt indicating the date this is done. A decision <br />date will be established 30 days from the date all of the requested information is found to be sufficient, unless the <br />application is found to be complex in which case the decision date may be as much as 90 days from the date of <br />the sufficiency determination. Venture Resources has sixty (60) days to submit all necessary documents that the <br />DRMS needs for an application to be considered filed. If, at the end of the sixty day period, the application has <br />not been determined to be filed with the DRMS, the DRMS shall deny the application and terminate the <br />application file. This letter shall not be construed to mean that there are no other technical deficiencies in <br />Venture Resources application. The DRMS will review Venture Resources application to determine whether it is <br />adequate to meet the requirements of the Mined Land Reclamation Act after submittal of all required items. <br />Sincerely, <br />'?Z' <br />Allen C.
