The application was received September 25, 2009, and the <br />application was determined to be complete on September 29, 2009. The following adequacy items were <br />identified during the Division's review: <br />On Page 3-2.6, Peabody Investments Corp, revised 09/09, at the top of the page, Rick A. Bowan is <br />still listed as Senior Vice President. Please update the page to show that his position of Senior <br />Vice President was End Dated on 2/1/2009. <br />2. In AVS, L. Brent Stottlemyre, is listed as a Corporate Office with a memo title of "Chief <br />Accounting Officer (07/25/06)" with a start date of 7/19/2006 for Peabody Energy Corporation. <br />He is not listed on the revised pages submitted in the minor revision. Please verify that L.
