<br />Exceptions
<br />Any policy we issue will have the following exceptions unless they are taken care of to our satisfaction.
<br />1. Taxes or assessments, not certified to the Treasurer's Office.
<br />2. Any facts, rights, interests or claims which are not shown by the public records, but which could be ascertained by an
<br />iinspection of the land or by making inquiry of persons in possession thereof.
<br />3. 'Easements, or claims of easements, not shown by the public records.
<br />4. Discrepancies, conflicts in boundary lines, shortage in area, encroachments, and any other facts which a correct survey
<br />and inspection of the land would disclose, and which are not shown by public records.
<br />5. Any lien, or right to a lien, for services, labor or material theretofore or hereafter furnished, imposed by law and not
<br />shown by the public records.
<br />6. Any and all unpaid taxes, assessments and unredeemed tax sales.
<br />7. Any water rights or claims or title to water, in, or under the land.
<br />8. Unpatented mining claims; reservations or exceptions in patents or in acts authorizing the issuance thereof; water rights,
<br />claims or title to water.
<br />9. "EXCEPTING AND RESERVING TO THE UNITED STATES FROM THE LANDS GRANTED
<br />1. A right-of-way thereon for ditches and canals constructed by authority of the United States, Act of August 30, 1890, 26
<br />Stat. 391; 43 U.S.C. 945;
<br />2. All mineral deposits in the lands and to it or persons authorized by it the right to prospect, mine and remove such
<br />deposits from same under applicable law;"
<br />as reserved in United States Patent dated December 19, 1968 and recorded January 8, 1969 in Book 357 at Page 925, and
<br />any and all assignments thereof or interests therein.
<br />10. "EXCEPTING AND RESERVING to the Grantors one-half (1/2) of all their present right, title and interest in and to the
<br />oil, gas, coal and other minerals in, on, or beneath the above-described premises", as reserved by Linda S. Weinstein, as
<br />Guardian of the Estates of Mark W. Spicer and Stephen L. Spicer in the Deed to Gordon Charles Winn 11, and Dennis A.
<br />Winn, a partnership doing business under the firm name and style of Bell Rock Sheep Co., dated December 21, 1976 and
<br />recorded December 22, 1977 in Book 436 at Page 11, and any and all assignments thereof or interests therein.
<br />11. "EXCEPTING AND RESERVING to the Grantors one-half (1/2) of all their present right, title and interest in and to the
<br />oil, gas, coal and other minerals in, on, or beneath the above-described premises", as reserved by Anna Belle Spicer,
<br />Thomas G. Spicer, R. Edward Spicer, Virginia S. Neslund, James G. Spicer, Margaret A. McMullen, Claudia S.
<br />Alexander and Mary P. Spicer Long and Linda Spicer Weinstein in the Deed to Gordon Charles Winn II, and Dennis A.
<br />'Winn, a partnership doing business under the firm name and style of Bell Rock Sheep Co., recorded December 22, 1977
<br />in Book 436 at Page 18, and any and all assignments thereof or interests therein.
<br />12. Right-of-Way for Moffat County Rd. #21, insofar as said Moffat County Rd. #21 may affect the subject property as
<br />shown on the official County Road Map of Moffat County, revised July 20, 1994 and as recorded October 9, 1996 as
<br />Reception No. 1996L-3927, and where no Easement and/or Right of Way exists of record for said road.
