<br />Requirements
<br />The following requirements must be met:
<br />(a) Pay the agreed amounts for the interest in the land and/or the mortgage to be insured.
<br />(b) Pay us the premiums, fees and charges for the policy.
<br />(c) Provide us the "Affidavit and Indemnity to First American Title Insurance Company" signed by the parties listed in
<br />Paragraph 3, Schedule A of this Commitment and notarized.
<br />(d) The following documents satisfactory to us must be signed, delivered and recorded:
<br />(e) Partial Release by the Public Trustee of Moffat County of the Lien of Deed of Trust from John Peroulis and Sons,
<br />A Colorado Partnership, and Four Mile Sheep, LLC, A Wyoming Limited Liability Company, for the use of The
<br />Equitable Assurance Society of the United States to secure $2,500,000.00, dated February 17, 1999 and recorded
<br />February 19, 1999 as Reception No. 1999L-691, insofar as said Deed of Trust affects the subject property.
<br />NOTE: Assignment of the beneficial interest in the above Deed of Trust to U.S. Bank National
<br />Association as Custodian/Trustee in the document recorded October 22, 2002 as Reception
<br />No. 2002L-4765.
<br />NOTE: Which Deed of Trust has been subordinated to the Lien of the Deed of Trust recorded
<br />August 21, 2002 as Reception No. 20021-3734 by the Subordination Agreement
<br />recorded June 21, 2002 as Reception No. 2002L-2699 and corrected by the Subordination
<br />Agreement recorded August 19, 2002 as Reception No. 2002L-3674.
<br />(f) Release of the land herein from the effect of a Financing Statement from John Peroulis and Sons, and Four Mile
<br />Sheep, LLC, debtors, to The Equitable Life Assurance Society of the United States, secured party, recorded
<br />:February 19, 1999 as Reception No. 19991-692, and as continued by the document recorded February 3, 2004 as
<br />!Reception No. 2004L-598, giving notice of a security interest pursuant to the Uniform Commercial Code.
<br />NOTE: Assignment of the beneficial interest in the above Financing Statement by various recorded
<br />assignments, with the final assignment to RABO Agriflnance by the instrument recorded June
<br />22, 2009 as Reception No. 2009-2463.
<br />(g) Partial Release by the Public Trustee of Moffat County of the Lien of Deed of Trust from John Peroulis and Sons,
<br />A Colorado General Partnership, and Four Mile Sheep, LLC, a Wyoming Limited Liability Company, and Breeze
<br />Group, Inc., a Colorado Corporation, for the use of The Equitable Life Assurance Society of the United States to
<br />secure $1,600,000.00, dated October 19, 2000 and recorded October 23, 2000 as Reception No. 2000L-4287,
<br />!insofar as said Deed of Trust affects the subject property.
<br />NOTE: Assignment of the beneficial interest in the above Deed of Trust to U.S. Bank National
<br />Association as Custodian/Trustee by the instrument recorded October 22, 2002 as
<br />Reception No. 20021-4764.
