s <br /> <br />For the above reasons, I am requesting that the State conduct an on-site inspection to see the berm <br />and consider how it relates to (or impacts) the permit area and the reclamation plan for the Bonser <br />Pit. As the reclamation plans are approved by the State, the County can not require that the berm be <br />removed as part of that plan. <br />As the berm was constructed with overburden material from the gravel pit, we are asking if your <br />office can determine if it falls outside the permit boundary, and what impacts it may have on the <br />approved reclamation plan if it remains in place. If either of these is a concern from the State, this <br />may be sufficient grounds for getting a commitment from the applicant to removed the berm <br />following mining operations. Getting this commitment would address the County's interest with <br />regard to concerns raised by the neighborhood.
