2 <br />(b) The slope of the land is 6 percent or greater. This soil mapping unit is mapped as 3-12% slope. <br />(c) The land is not irrigated or naturally subirrigated, has no developed irrigation water supply that <br />is dependable or of adequate quantity. The 50C soil mapping unit is not irrigated or subirrigated, <br />nor are there ditches or other irrigation structures constructed near this mapping unit. <br />(d) A very rocky surface exists, or the land is frequently flooded. The land has not been shown to be <br />flooded and the surface does not appear significantly rocky. <br />(e) The growing season is less than 90 days. The NRCS Soil Survey defines the 50C soil mapping <br />unit as having 65 frost free days. <br />Based upon the NRCS Soil Survey and Rules 2.04.12(a), (c) and (e), DRMS would not consider the <br />Lintim Loam 3-12% soil mapping unit to qualify as Prime Farmland, nor is the operator proposing to <br />disturb areas that are classified as the 50C mapping unit. <br />As DRMS does not believe that Prime Farmlands exist within the proposed permit area, Rule 4.25 <br />does not apply in this instance.
