M. COMMENTS-COMPLIANCE <br /> Below are comments on the inspection. The comments include discussion of observations made during the <br /> inspection. Comments also describe any enforcement actions taken during the inspection and the facts or <br /> evidence supporting the enforcement action. <br /> This was a complete inspection conducted by Joe Dudash of the Colorado DRMS.Bill Bear represented the <br /> operator,Bowie Resources LLC.Longwall mining is progressing in the B-8 panel.However, in order to keep <br /> the methane levels down within the mine,the longwall is operating slowly but steadily. <br /> Main Mine Site <br /> The rock catchment berm above the utility bench was in place.No large rocks had been caught by the catchment <br /> berm. The utility bench's outside edge berm and the back ditch were in place.The topsoil stockpile on the west <br /> side of the utility bench had a good vegetative cover and the topsoil sign was up.The road leading up to the <br /> utility bench was passable and in good condition.The road's outside berm was up.The cut slope above the road <br /> was stable. There was one small seep in the cut slope above the road. <br /> There was only a small volume of coal that was stockpiled on the D-seam portal bench. The culverts and ditches <br /> in this area were functioning properly. The berm was in place on the outside edge of the bench. There were no <br /> problems with any of the facilities on this bench,including the fuel facility and cap and powder houses. The <br /> highwall and the bench's cut and fill slopes were stable. The material storage areas were well organized. <br /> There were no problems with any of the facilities on the B-seam portal bench as well.The recently reworked <br /> highwall area appeared to be stable. The ditch and culverts were in place on the bench, as was the bench's <br /> outside edge wall.There were no stability issues with the excess material storage area across the haul road. <br /> The main topsoil stockpile was well vegetated. Topsoil signs were up.The adjacent material storage area was <br /> well organized.The entrance road culvert was clear.There were no issues with the wash plant and its associated <br /> water tank area.The operator is washing coal from the West Elk Mine as well as some of its own coal. <br /> There was a small amount of coal stockpiled on the main coal stockpile area at the bottom of the hill. There <br /> were no problems with fugitive dust or coal dust being tracked onto the highway. The culverts and ditches that <br /> bring disturbed area runoff into pond B were functioning properly. There was only a small volume of water in <br /> pond B. The float was attached to the primary discharge pipe. The pond embankment was stable and the <br /> emergency spillway was free of any blockage. <br /> The mine id sign was up at the mine entrance. Surface disturbance markers were up around the disturbed area. <br /> There were no problems with slope stability with any of the benches' cut and fill slopes. The paved main haul <br /> road was in good condition,road ditches and culverts were functional and guard rail was up. <br /> There were no problems observed at the pump house. The mine id sign was up and straw bales were in place. <br /> Coal Waste(Gob) Stockpile Area <br /> The gob pile haul road was in good condition,with the road berm and ditch in place. The outlet of the road <br /> culvert at the entrance to the coal waste pile area will need some cleaning soon.The culvert is still functional, <br /> however. The operator was drying out pond C for cleaning. The pond C primary and emergency discharge <br /> structures were functional.Pond D had water to about the primary discharge pipe level. The gated primary valve <br /> was closed.The riprapped emergency spillway was functional. <br /> 1 <br />
