11.

$273,624.00 Lyndon Property Insurance Co.
Section IV - Adequacy Review
Because of the recent _revisions for the Bowie No. 2 Mine, the permit application has basically been
kept up to date. The Division has only two adequacy review questions and one comment:
1.. On permit application page 2.05-39ii, it is stated that about 3,000 cubic yards of soil material
from the Hubbard Creek vent shaft project would be temporarily stored at the partially
reclaimed Bowie No. 1 Mine highway coal stockpile area. The soil material would be brought
back to the vent shaft site for future reclamation. Is this soil material still at the Bowie No. 1
Mine highway coal stockpile area or was it used in the backfilling and grading operation at the
Bowie No. 1 East Mine? If the soil material was used in the Bowie No. 1 Mine reclamation
project, please provide a plan for obtaining the soil material needed for reclamation at the
Bowie No. 2 Hubbard Creek vent shaft area.
2. As documented in the 2007 Annual Subsidence Report, a landslide had occurred in the
Freeman Gulch area in June 2007. Presumably, the landslide was a result of longwall mining
on the east end of the B-6 longwall panel. As was required in Exhibit 15 of Volume III and
shown on Map 14-B of Volume II, one row of pillars, 100 feet wide, of competent coal had
been left in place as an outcrop barrier pillar to prevent outcrop failure. Since outcrop failure
had occurred, please reexamine the issue of outcrop barrier pil

e results to Bowie Resources for comment. The Division requests an expeditious response to
adequacy question number 1 so that the reclamation cost estimate will be complete.
c:\word\bowie2\2009 Midterm Bowie #2 Findings
12
