III. COMMENTS-COMPLIANCE <br /> Below are comments on the inspection. The comments include discussion of observations made during the <br /> inspection. Comments also describe any enforcement actions taken during the inspection and the facts or <br /> evidence supporting the enforcement action. <br /> This was a complete inspection conducted by Joe Dudash of the Colorado DRMS.Because the Hawk's Nest <br /> Mine is a revoked mine site,the inspection frequency has been reduced to one complete inspection and three <br /> partial inspections per calendar year.This change has been in effect since October 22, 2005. The Hawk's Nest <br /> Mine is an underground mine that was reclaimed with forfeited bond money. The reclaimed mine site consists <br /> of two separate sections; a west mine and an east mine. The mine site area was dry. <br /> West Mine <br /> The county road that is the only access to the reclaimed mine site was in good condition.The dirt and gravel <br /> road over the railroad tracks that leads to the DMEA substation and the west mine site was dry. There were no <br /> railcars that blocked the railroad crossing. <br /> There was a very good to excellent vegetative cover at the west mine.There were no observances of any <br /> noxious weeds in this area.The stream buffer zone signs were up parallel to the river. The cap was on the <br /> ground water well pvc pipe. The sedimentation pond was dry and the pond embankment and pond inslopes and <br /> pond bottom were well vegetated.The pond's concrete single open channel spillway was clear of any debris. <br /> The reclaimed west mine appeared to be stable.There was no evidence of any erosional problems or slope <br /> stability problems. <br /> East Mine <br /> At the west mine,the two small mudslides that lie immediately adjacent to and north of the county road did not <br /> encroach onto the road.The mudslides are in the backfilled cut slope area of the reclaimed mine site.The <br /> eastern most mudslide had a little pooled water at its base.The western most mudslide is starting to block the <br /> inlet to the western most of the two road culverts. The eastern most road culvert was clear of any debris. The <br /> riprapped channels below the two road culverts had sufficient capacity. <br /> The river side berm was in place along the river at the reclaimed east mine. The west side of the east mine had a <br /> moderately good vegetative cover but the east side had only a moderate to poor vegetative cover.There were <br /> several patches of knapweed on the east side of the east mine. <br /> Except for the two small mudslides, there were no indications of slope instability or gullying at the reclaimed <br /> east mine. <br /> Records <br /> There are no mine records associated with this revoked site. <br /> c:/word2007/hawksnest/inspO9O9 <br />
