III. COMMENTS-COMPLIANCE <br /> Below are comments on the inspection. The comments include discussion of observations made during the <br /> inspection. Comments also describe any enforcement actions taken during the inspection and the facts or <br /> evidence supporting the enforcement action. <br /> This was a partial inspection conducted by Joe Dudash of the Colorado DRMS.No one represented the <br /> operator,Minrec, during the inspection.Minrec has requested Phase II and III bond release(SL-2) for the entire <br /> site. All required reclamation has been successfully completed, as was evidenced during the two bond release <br /> inspections of August 27, 2008 and August 27, 2009. The Division will have a proposed decision shortly. <br /> Roads <br /> The county road up the Hubbard Creek canyon was dry and in good condition.The reclaimed mine site access <br /> road across Hubbard Creek and the light use road that leads to reclaimed pond 5 were also in good condition. <br /> The mine access road and the road to reclaimed pond 5 are to be kept at the surface lessee's(Oxbow Mining) <br /> request.The entrance gate,which was locked,will also remain. <br /> Signs and Markers <br /> The mine ID sign and the"records location"sign were taken off of the entrance gate. Surface disturbance <br /> markers and survey markers were also removed from the reclaimed mine site. <br /> Hydrolo�y <br /> The Hubbard Creek culvert at the entrance to the site was clear of any blockage. Hubbard Creek was flowing. <br /> The diversion ditch that channels runoff around the buried coal waste on the reclaimed mine slopes had <br /> sufficient capacity and a good vegetative cover. <br /> The upland diversion ditch at the reclaimed coal stockpile area was well vegetated and was clear of debris. <br /> All of the underdrains at the base of the reclaimed slopes were dry.There were two small seeps half way up the <br /> reclaimed slopes but they were barely flowing. <br /> Noxious Weeds <br /> The operator has sprayed the thistle and knapweed that was growing on the reclaimed mine site. <br /> Reclamation <br /> Pond 4 and pond 5 have been reclaimed. Silt fence remains at the down gradient end of both ponds.No <br /> erosional problems were observed. The two reclaimed pond areas are establishing a moderate vegetative cover. <br /> The revegetated mine slopes had a very good stand of vegetation.No indications of erosional problems were <br /> observed.There were no signs of slope instability, such as bulging or cracking.The reclaimed coal stockpile <br /> area was also well vegetated. <br /> Al of the piezometers that had been on the reclaimed mine slopes were reclaimed. <br /> c:/word2007/blueribbon/inspO9O9 <br />
