M. COMMENTS-COMPLIANCE <br /> Below are comments on the inspection. The comments include discussion of observations made during the <br /> inspection. Comments also describe any enforcement actions taken during the inspection and the facts or <br /> evidence supporting the enforcement action. <br /> This was a partial inspection conducted by Joe Dudash of the Colorado DRMS.No one represented the operator <br /> during the inspection.There was intermittent activity at the loadout during the inspection. <br /> Roads <br /> The paved main entrance road was in good condition.There was a black stain on the highway at the loadout's <br /> entrance due to truck tratfic but it was not a problem. The graveled east entrance road was in good condition. <br /> And the east gate was open. The railroad track light use road was passable. <br /> Signs and Markers <br /> The mine identification signs were up at the main entrance,east entrance and along the side road near the <br /> railroad tracks. The id signs contained the required information. <br /> Hydrology <br /> The west side dugout pond was completely dry. The pond's combination open channel spillway was clear of any <br /> debris. The east side sediment pond was also dry. The gated primary discharge pipe was closed and the <br /> emergency spillway was riprapped and clear of debris. The pond's inslopes and embankment were well <br /> vegetated. There was a small pile of coal waste next to the east side sediment pond. <br /> The culverts around the loadout were clear.Ditches also had sufficient capacity.The straw bales and silt fence <br /> along the railroad track small area exemption were in place. <br /> Facilities <br /> One coal haul truck unloaded coal into the grizzly and several railcars were loaded with coal during the <br /> inspection.Also,the crushing/screening machinery was in operation intermittently. There were no indications of <br /> fugitive dust going offsite. <br /> There were no problems associated with the material storage areas,coal handling facilities,substation, fuel <br /> facility and the loadout office. <br /> Topsoil Stockpiles <br /> The east side topsoil stockpile had a good vegetative cover. The collection and diversion ditches were well <br /> vegetated. Topsoil signs were up. The west side topsoil stockpile also had a good vegetative cover. The <br /> stockpile's collection berm was in place.Topsoil signs were up on the stockpile. <br /> c:/word2007/terror/inspO9O9 <br />
