<br />27. DRMS - Please update the operations description of the gob piles on permit
<br />application page 2.05-8 in Volume I to include the status, including that of TR-64,
<br />for all of the operational gob piles.
<br />BRL - Page 2.05-8 & 9 have been revised to include more recent Gob pile
<br />permit information.
<br />28. DRMS - Construction Permit No. 03DL0923F, found in Exhibit 10 of Volume III,
<br />limits the stockpiling of coal waste to not exceed 2,000,000 tons. Please inform
<br />the Division as to the total coal waste stockpile tonnage if TR-64 is approved.
<br />BRL - MR-90 approved by DRMS on August 20, 2008, incorporated updated
<br />construction permit number 03DLO923F into the PAP. The amended permit
<br />contains the following statement regarding stockpile tonnage: "Coal mine waste
<br />(gob), topsoil and excavated materials stockpiled shall not exceed 3,155,000
<br />tons". If TR-64 is approved, the new coal mine waste stockpile will be 2,450,000
<br />CY, which is approximately 3,626,000 tons of coal mine waste. The projected
<br />coal mine waste volume of 2,450,000 CY is based on final, in-place material and
<br />currently, neither pile is in a final phase. While the Operator believes they are
<br />still in compliance with Construction Permit number 03DLO923F as the stockpiled
<br />material in the permit is for the final volume, an amendment will be filed to
<br />account for the `final' volume of material of 3,626,000 tons.
<br />29. DRMS - As required under Rule 2.10.3(1)(a), please add the permit boundary
<br />designation on Map 15-3 of Volume II and on Figure 1 of Volume IX.
<br />BRL - The layer for the Permit Boundary was mistakenly turned off and has
<br />been turned back on. Please see Map 15-3 & Figure 1.
