The Whirlwind Mine water treatment plant is located at 30100 5110 Road, <br />Gateway, Colorado 81522. Discharge of treated water from the Whirlwind Mine is <br />allowed in accordance with Colorado Discharge Permit System (CDPS) permit number <br />CO-0047562. <br />On November 24, 2008 the Whirlwind Mine was put on stand-by status. At this time, the <br />mine will continue to be dewatered during stand-by and Energy Fuels will continue to <br />treat and discharge mine water and to comply with CDPS permit conditions. Mine water <br />collects in the mine at a slow rate (approximately 2 to 3 gpm) and is being pumped into <br />the untreated water tank and treated in batch runs, as necessary. Currently, batch runs are <br />occurring at a rate of approximately one run per month. One batch run occurred from <br />August 9 to 12, 2009. A monthly discharge sample was collected on August 10, 2009 in <br />accordance with the aforementioned permit.
