Kirkpatrick, Esq. <br />1/30/2007 <br />Page 3of5 <br />REPLACEMENT SOURCES <br />The source of augmentation water to replace out-of-priority depletions will <br />be water from the augmentation pond(s). Pond #1 is adjacent to the milling <br />operation near the portal to the Idaho Mine. The lined pond would not be located <br />on a stream channel but would be a combination of excavation and embankment <br />in a relatively flat area. Augmentation water from the pond will be released <br />through a low level outlet pipe to the existing channel that presently conveys <br />mine discharge water to the La Plata River. A meter with instantaneous and <br />accumulating readings will be placed on the outlet pipe so the Water <br />Commissioner can monitor the amount of water released for augmentation. <br />Evaporation from the ponds will not be augmented. The amount diverted for the <br />ore processing cannot exceed the amount released from the augmentation <br />ponds. The attached accounting form will be used in the operation of this plan. <br />CONDITIONS OF APPROVAL <br />This plan is hereby approved pursuant to Section 37-92-308(4), C.R.S. <br />and the following conditions: <br />1. This SWSP shall be valid for the period of April 1, 2007 through March <br />,31, 2008, unless otherwise revoked, modified, or superceded by <br />decree. Additional SWSP's are required until a court decreed plan for <br />augmentation is obtained for the proposed uses. Should an additional <br />SWSP be requested, the provisions of CRS 37-92-308(4)(b) shall <br />apply. The statutory fee of $300 will be required pursuant to CRS 37- <br />92-308(8). Any request for an additional SWSP must be submitted to <br />this office no later than January 1, 2008. <br />2. Subject to approval by the Division Engineer, the Applicant may lease <br />or purchase additional replacement water as identified in case no. <br />06CW91 and the SWSP request. The Applicant must provide a copy <br />of a lease/purchase agreement to the State Engineer's Office and the <br />Division Engineer for use of such additional replacement water. <br />3. The Applicant shall provide to the Division Engineer, within 30 days of <br />the date of this approval, an electronic Excel spreadsheet showing, by <br />WDID, the owner or contact person name, address and telephone <br />number for each structure covered or used in this SWSP. The <br />Applicant shall also provide to the Division Engineer an updated <br />version of this spreadsheet if there are any owner or contact person <br />changes within the approval period of this SWSP. <br />4. The Applicant shall provide daily accounting (including, but not limited <br />to diversions, depletions, replacement sources, and river calls) on a <br />monthly basis.
