The. Division of Reclamation, Mining and Safety has begun the review process for the above referenced 112c
Co1Ilversion application. The project appears to be a straight forward request to convert the existing 110c to a
112c increasing the disturbed acreage from 7.57 acres to 21.75 acres. A review of the application has revealed a
feud clarifications and issues that need to be addressed.

1) Per Rule 1.6.5(2), within ten days after the last publication or as soon thereafter as proof has been obtained,
the applicant shall mail proof of publication required by Rule 1.6.2(1)(d) to this office. Proof of publication
may consist of either a copy of the last newspaper publication, to include the date; published, or a notarized
statement from the news paper. An application may not be approved until such proof has been obtained.
Please provide this office a proof of publication.

2) Per Rule 6.4.3(e), the pre - mine plan map must indicate the type of present vegetation covering affected
lands. Please submit a pre-mine plan map that identifies the vegetation that currently exists at the site.
Thi is a preliminary review. Other issues may arise from other agency comments, and as more information is
sup lied. This application cannot be approved until the issues brought forth are adequately addressed. Please
sub it a response to the following issues as soon as possible, but no later than October 19, 2009 so the decision
due date set for October 28, 2009 can be met. If your response or a written extension request are not received by
Octl her 19, 2009 this application may be denied.
