slurry wall to determine base ground water elevations at this location and to measure <br />the ground water impact after the site is reclaimed the slurry wall is installed. Please <br />submit a ground water monitoring plan. Include in the plan defined ground water <br />elevation trigger points and a mitigation plan if these trigger points are met. " <br />Applicant's Response: <br />Like the Division, the Applicant also believes ground water mounding is a valid issue. <br />The Applicant will continue to monitor ground water elevations until released from <br />this requirement by the Division. <br />The Applicant will use an abandoned ground water well located on the west end of the <br />Spier's property to monitor ground water elevations under their property (see Exhibit <br />"C-2" Sheet 2 of 7 for the location of the Spier monitoring well). Ground water <br />monitoring data from the Spier well will be included with the rest of the ground water <br />monitoring data and reported to the Division in the Annual Reclamation Report. <br />Upon completion of mining and reclamation of the area around the Spier property the <br />elevation of the reclaimed ground, including the slurry wall west of the McCann <br />Ditch, will be on average 15 feet lower than Spier's property. Therefore, ground water <br />mounding if any will not impact the Spier's property. <br />EXHIBIT L <br />19. "According to the proposed reclamation plan, Ready Mixed will backfill 23.3 acres of <br />the current open water pond with sediment from the processing area and possibly <br />excess overburden. Based on the reclamation plan map and the description of the <br />disturbance of this cell, the Division estimates that approximately 893, 000 cubic <br />yards of material will be needed to backfill this cell. At this current time, how much <br />material in on site to backf ll the pit excavation and where is the material located? <br />The Division is required to set the financial warranty at a level which reflects the <br />actual current cost of fulfilling the conditions of the Reclamation Plan per Rule <br />4.2.1(1). If this material is not located within the permit boundary, the division will <br />need to hold an appropriate bond amount to import the material needed to backf ll <br />the entire 23.3 acre pond. " <br />Applicant's Response: <br />The Applicant has prepared the following information related to the reclamation plan <br />for Bromley Lakes Cell 2. <br />Cell # 2- The north half of Cell 2 is currently used for wash fines <br />disposal. After the northern portion of Cell 2 has been filled with wash <br />fines the operator will begin filling the south portion of the Cell with <br />wash fines. Wash fines will be discharged in the southern portion of <br />Cell 2 which is approximately 23.3 acres in size. The Applicant <br />estimated that eight (8) acres of the current 23.3 acre pond will be <br />backfilled with wash fines which will leave a balance of 15.3 acres to <br />10/2/2009
