Applicant's Response: <br />The Applicant proposes to follow the mining setback recommendations contained in <br />the slope stability analysis prepared for Ready Mixed Concrete Company by Deere & <br />Ault dated: September 2009 (see attached Stability Exhibit). Also, see attachment 6 <br />the Spier "Agreement" dated September 14, 2009 by and between K.C and Donna <br />Spier and Ready Mixed Concrete Company. <br />Proposed McCanne Ditch Mitimation Plan <br />25) "On page 18 of the Adequacy Review Response, you state that the relocated McCanne <br />ditch will be lined with bentonite to minimize leakage during the mining process? <br />While the Division agrees that this will minimize leakage from the ditch during the <br />mining process, this may not be a logical long term solution. Based on the four <br />principle sources of water that supply the Ditch outlined in your response, a bentonite <br />liner would for the most part cut off the groundwater source to the ditch. Please <br />explain how the pre-mining flow regime of the ditch will be restored if its ground <br />water source is cut Off? " <br />Applicant's Response: <br />The Applicant will not use bentonite to seal the ditch. <br />Regarding restoration of the pre-mining ground water flow regime, during <br />reclamation, RMCC will install a French Drain system along the west side of Brighton <br />Road. This drain will be installed between the compacted backfill and the mining <br />setback along Brighton Road. Ground water intercepted by the French Drain will be <br />discharged to the McCanne Ditch. <br />10/2/2009 11
