Ideally, for the purpose of calculating the financial warranty the Applicant's preferred <br />option is number 3. The Applicant's representative has discussed this option with Ms. <br />Joanna Williams at the SEO and is exploring the feasibility of obtaining a letter of the <br />type described under option number 3. Unfortunately, it is unlikely that such a letter <br />can be obtained prior to the Division's October 2009 decision date for Bromley Lakes <br />Amendment 002. <br />Therefore, for the purpose of calculating the financial warranty in a timely manner, <br />and only that purpose, the Applicant requests that the Division use option 2 to address <br />possible depletions associated with Phase 18. <br />Regarding Cell 2, the Applicant does not intend to leave any exposed ground water <br />once reclamation is completed (see Applicant's response to item 19 above). The <br />following picture shows wetlands created in a wash fines settling pond that does not <br />contain any exposed ground water.
