Cattany <br />Division Director <br />Natural Resource Trustee <br />RE: Proctor Pit, 112 Construction Materials Permit Application; DRMS <br />File#: M-2009-054, Adequacy Review #2 <br />Dear Mr. Banks, <br />The Division conducted a pre-operation inspection of the proposed mining operation on <br />October 1, 2009. During the inspection, the Division noticed an inadequacy of some of <br />the material submitted in the permit application in regards to the fence located near the <br />southern proposed permit boundary. <br />Rule 6.4.3 Exhibit C - Pre-Mining and Mining Plan Maps(s) of Affected Land <br />1.) The three strand barbed wire fence located near the proposed southern permit <br />boundary is not fully displayed on the Exhibit C maps. The fence continues to run west <br />and comes within 30 feet of the south western corner marker and within 200 feet of the <br />proposed Affected Land. Please draw and label the fence on the Exhibit C maps and <br />indicate the name of the owner of the structure on the map. <br />Rule 6.4.19 Exhibit S - Permanent Man-Made Structures <br />2.) The fence appears to be within 200 feet of the Proposed Affected Land. In <br />accordance with Rule 6.4.19, when mining operations may adversely affect the stability <br />of any significant, valuable and permanent man-made structure located within 200 feet of <br />the Affected Land, the applicant may either: <br />Office of <br />Office of <br />Mined Land Reclamation Denver • Grand Junction • Durango Active and Inactive Mines
