I//. COMMENTS - COMPLIANCE <br /> Below are comments on the inspection. The comments include discussion of observations made during <br /> the inspection. Comments also describe any enforcement actions taken during the inspection and the <br /> facts or evidence supporting the enforcement action. <br /> This was a partial inspection conducted by Tom Kaldenbach of DRMS. Ryan Sweetwood of <br /> Mountain Coal Company represented the operator. <br /> Photographs taken during the inspection are attached to the end of this report. With the operator's <br /> consent, this report was issued from the Denver office of DRMS. <br /> The longwall was active just past the middle of E-Seam Panel 1. The ground was dry. <br /> Hydrologic Balance <br /> No discharge was occurring at the mine water discharge site in Sylvester Gulch(CDPS outfall 017). <br /> Processing Waste <br /> The outslope face of the Refuse Pile Expansion(RPE)pile showed no signs of structural instability. <br /> Much of the face has recently been graded smooth and mulched. Survey markers were in place on the <br /> face. The operator is backhauling its refuse from the Bowie No. 2 Mine wash plant to the RPE at the <br /> West Elk Mine where it is held in a temporary stockpile on top of the RPE and then is incorporated <br /> into individual lifts. MR-350 approved incorporating this backhauled refuse into the RPE. <br /> Support Facilities <br /> No problems were found in the following areas: trash compactor, explosives storage area, the <br /> Sylvester Gulch mine water pumping facility, and the polishing pond. The new mine water treatment <br /> pond in Sylvester Gulch is nearing completion. This work was approved in TR-116. The outslopes of <br /> the pond have been covered with straw mat and straw mulch for erosion control. The operator's close <br /> attention to erosion control on this new construction is commendable. <br /> A Delta-Montrose Electric Association(DMEA) crew was installing new wooden-pole powerline <br /> between pond MB-5 and the adjacent slope to the south(see photo below). A two-track road dirt road <br /> has been dozed for accessing this powerline. An operator's representative explained that the powerline <br /> is not part of the mine operation. <br /> General Mine Plan Compliance <br /> The operator appeared to be following the approved mine plan. <br /> Air Resource Protection <br /> No fugitive dust problems were found during the inspection. <br /> Documents Received <br /> 3 <br />
