M. COMMENTS-COMPLIANCE <br /> Below are comments on the inspection. The comments include discussion of observations made during the <br /> inspection. Comments also describe any enforcement actions taken during the inspection and the facts or <br /> evidence supporting the enforcement action. <br /> This was a partial inspection of the McClane Canyon Mine conducted by Mike Boulay of the Division <br /> of Reclamation, Mining and Safety(DRMS) on September 23, 2009. Rodney Head of McClane <br /> Canyon Mine was present during the entire inspection. Weather conditions were sunny and cool. Coal <br /> was being conveyed and hauled from the mine at the time of the inspection. <br /> Roads <br /> The haul road is well maintained and road ditches were in good condition. <br /> H, drologic Balance <br /> It rained the day prior to the inspection. The silt fence located at the lower end of the haul road by the <br /> bridge was retaining water. Ground conditions were otherwise dry throughout most of the site. East <br /> Salt Creek had only a small amount of water flowing. Drainage structures and diversion culverts in the <br /> portal area were clear of debris and appeared to be functional. The sediment pond was retaining a <br /> significant amount of muddy water at a level just below the principal spillway. Site sediment control <br /> features were in good working order. <br /> Processing Waste <br /> The coal waste pile area located above the sediment pond was inspected. The berm and the clean <br /> water diversion ditch around the waste pile and sediment storage area are well maintained and stable. <br /> Waste is being properly contained and no problems were identified. <br /> Support Facilities <br /> The shop and facilities areas were well kept. Perimeter areas at these locations were maintained, and <br /> no problems were noted at any of the mine site facilities during this inspection. <br /> Air Resource Protection <br /> At the time of the inspection, MCM was watering roads for dust suppression. <br />
