III. COMMENTS -COMPLIANCE <br /> Below are comments on the inspection. The comments include discussion of observations made <br /> during the inspection. Comments also describe any enforcement actions taken during the inspection <br /> and the facts or evidence supporting the enforcement action. <br /> This was a Partial Inspection of the Hamilton Mine conducted by Marcia Talvitie of the Colorado <br /> DRMS on Monday, 21 September 2009. Weather conditions were sunny and cool, with a strong <br /> breeze. The inspection commenced at 11:50 a.m. <br /> Permitting Topics <br /> • MR-10, which modifies the Annual Reclamation Report requirements to include weed control <br /> activities,was approved on 25-Aug-2009. <br /> • TR-09 seeks to have Pond B retained as a permanent impoundment. The Division's <br /> Preliminary Adequacy Review letter was issued on 13-Aug-2009. The Decision date has been <br /> extended to 30-Apr-2010 to provide sufficient time to analyze water quality. <br /> • TR-10 will incorporate a Soil Loss Demonstration into the permit. The Division issued its <br /> Preliminary Adequacy Review on 18-Sep-2009. <br /> Hydrologic Balance <br /> • Ponds A and B were both dry. <br /> • The emergency spillway for Pond B was clear, and it did not appear that any maintenance is <br /> required. <br /> Revegetation <br /> • The eastern end of the Pond B dam was nearly devoid of vegetative cover, with the <br /> exception of some annual weeds. Noxious weeds observed earlier in the year appear to <br /> have been effectively controlled. <br /> • The bottom of Pond B is covered with tamarisk,sunflowers, and foxtail barley. <br /> • A stand of wavy-leafed thistles was observed on the west bank,just north of the ditch inlet in <br /> the southwest corner. A colony of Russian knapweed at the northern end of the western <br /> bank did not appear to have been sprayed this season. <br /> Topsoil <br /> • The topsoil stockpile located immediately south of Pond B was covered with vegetation, <br /> including Winterfat, rubber rabbit brush, sage brush, snakeweed, needle-and-thread grass, <br /> and Indian rice grass. A small amount of cheat grass was observed, but overall the <br /> vegetative cover is excellent, and the topsoil resource is being protected. Thistle rosettes <br /> observed in June had been sprayed. <br /> The inspection was concluded at 12:40 p.m. <br /> Hamilton Mine C-1991-078 21-Sep-2009 <br />
