III. COMMENTS -COMPLIANCE <br /> Below are comments on the inspection. The comments include discussion of observations made <br /> during the inspection. Comments also describe any enforcement actions taken during the inspection <br /> and the facts or evidence supporting the enforcement action. <br /> This was a Complete Inspection of the New Horizon Mine conducted by Marcia Talvitie of the Colorado <br /> DRMS beginning at 1:00 p.m. on Monday, 21 September 2009. Ross Gubka represented the operator, <br /> Western Fuels-Colorado, and was present throughout the entire inspection. <br /> The weather was clear, cool and breezy. Mining operations were shut down due to scheduled <br /> maintenance at the San Miguel Generating Station. <br /> Availability of Records <br /> Records were available at the mine office for review. A completed DRMS Availability of Records form is <br /> attached to this report. <br /> Permitting Summary <br /> • RN-05 - The Division issued its proposed decision to renew the New Horizon Permit on 24-Aug-2009. <br /> The Public Notice appeared in the San Miguel Basin Forum on the 3rd and 1 Oth of September. The 30- <br /> day public comment period will end on the 3,d of October. If no objections are received by that <br /> date, the renewal will likely be issued during the following week. <br /> • PR-06 - Stipulation 16 attached to RN-05 requires WFC to submit a permit revision no later than 30 <br /> days following the formal issuance of RN-05. Among other things, this PR will address post-mining <br /> land uses west of 2700 Road. <br /> • SL-12 - WFC's Public Notice will appear weekly through the 8th of October. Completeness will be <br /> determined within 10 days from that date, if all other items required have been received by the <br /> Division. The date of the bond release inspection has yet to be determined. <br /> • TR-59-The Division's Preliminary Adequacy Review is due on the 2nd of October. <br /> Sighs and Markers <br /> The annual AVS check was conducted during the inspection. Information presented on the sign posted <br /> at the mine entrance is current and correct. <br /> Roads <br /> • Above-ground electrical lines and buried telephone cable have been installed along the eastern <br /> and western (respectively) sides of the reconstructed 2700 Road. These two utilities will likely be <br /> included in the future bond release application for the roads. <br /> • Right-of-Way fencing has been installed along both sides of 5th Road, which extends westward from <br /> the support facilities area and bisects Pond 007. The fencing was installed to comply with County <br /> requirements. <br /> • Reclamation of the BB Detour Road will vary by landowner. Mr. Benson wishes for the road on his <br /> property (the western segment) to be left in place for his future use. Mr. Richards wants the detour <br /> on his parcel to be reclaimed. WFC plans to construct an access track to the diversion box on an <br /> easement along Richards' eastern fence line. Ross described the reclamation process for the road, <br /> and we discussed erosion control BMPs that would be appropriate to use (straw bales and excelsior <br /> logs). The Permit currently states that all of BB Detour Road is to be reclaimed. A revision application <br /> should be submitted which reflects that the Benson segment will be retained as a permanent <br /> feature. <br /> New Horizon Mine C-1981-008 21 Sep-2009 <br /> -1- <br />
